Hi.
On Thursday, Feb. 18 at 1030pm my wife returned from her daughter and son in law's home. She was in a good mood earlier in the day, but came home in a depressed mood. She then complained that she wished she had more money to help the kids, even though we , including her and I , have helped them repeatedly. This escalated into an argument. During the argument, as I got up to leave the room and the discussion, she grabbed my arm and as I pulled away severely scratched my arm . She them hit me in the mouth causing the upper pallet to be torn and bleed. I told her I could call the police and register an assault charge. She saw the bleeding. Then she really fumed. She left the house and went for a walk.
A few minutes later at 1130 pm two cops were at my door. One stayed outside with her and the other inside with me. She told her story separate from mine. Both cops, however saw the lip and pallet wound. Before they left , they suggested we separate for the evening. My wife went to her other daughter's house. This was at 1215 pm.
At 330 am, my doorbell was ringing. I carefully looked out the window and saw two patrol cars. I didn't open the door. They left.
At 800 am, my door bell was ringing. Now there were three patrol cars and they were walking around the property. Again, I didn't open the door.
At 900 am, the alarm was deactivated, the door unlocked and my wife comes in with the 6 officers.
They serve me with a Temporary Order of Protection. It had been granted at 1230 pm at the police station near my house. The hearing is in two weeks.
Two of the officers followed me around the house while I packed some items for the next two weeks. I asked them why I was being put out of my house. They said that she got the Temporary Order of Protection first and I had not applied for one despite the fact that I was the injured and battered parti.
They asked if I wanted to make a written statement to add to the report of the previous night. I did. They asked if I wanted to press charges and I said yes.
At noon, I went to the emergency room, they took pictures, examined me, wrote a report and gave the report to me with the pictures.
My question is....with the facts at hand, at the Hearing, once the judge sees the assault and battery, is it in my favor that the temporary order for protection in her favor be either dismissed or overturned and a new order be issued by the judge against her. This would include having her move out of the house.

Open Letter to Child Protective Services social workers
An Open Letter to Child Protective Services social workers
Dear CPS social worker,
I dont know you and you dont know me. Im sure you are expecting a bitter letter from a parent that had her children taken, but this letter is not meant to down you or be bitter toward you. It is a letter to hopefully, shed light and help you understand more about your role in this world.
You made the choice to study social work in college, maybe from the start, you knew working for child protective services was your goal or perhaps it is one of the first jobs you were hired on to, but either way, your career was aimed towards helping others. That tells me that at one point theres a chance you were a compassionate human being that only wanted to help and change lives. You never imagined your job would be this. Destroying families in the name of help, being forced to follow the rules even when you dont morally agree, and working for a system that is so poorly funded. You are over worked and over booked, the dream you had for your career is but a distant memory. I know you use to feel so deeply and your emotions effected your work, but eventually you became desensitized. You no longer feel like you should and you condone this by saying you cant get that involved with your cases.
Im sure you have witnessed some terrible things. Abuse, neglect, addiction, and mental health issues. You have seen the suffering of children and it is your job to save them. You take this job seriously and want what is best for the children. Its a shame that your heavy case loads and courts often keep you from doing what you know is right.Maybe you are one of the good ones, but are caught in a system that doesnt let you be good or maybe you arent one of the good ones, you feel nothing and are okay with ripping a family apart even if its not the right thing to do. You condone this by telling yourself that you are in a position to do what you have to do to protect these kids even if there is no viable evidence. You see yourself almost as a God playing Gods role. It doesnt concern you if it is right or wrong, because in your mind, you think it's better safe then sorry. You manipulate, you lie, you stare the grief of children and parents in the face without a flinch. Your income is good and your life isnt so bad, you probably have a beautiful family that you go home to every night to sleep peacefully with knowing that you are above the system.
The federal government pays a hefty incentive to every child that is in your system and forced into adoption. It pays well so even if you know that the children in the system are in for a hard life, you dont care, you terminate the rights of parents that love their children more than life. Perhaps these parents needed some advice, resources, a hand up or even a hand out, but they surely didnt deserve to lose their children. You hear their cries of grief and witness their rage, they beg and they plead. They fight ruthlessly and finish your case plans for you to find more problems that dont really exist. You condemn parents for the things they do then go home to do the same. You are a hypocrite, a sociopath, and a problem in this world. Im not bitter, I am honest. I hope you can take what I say and use it to think about the things that you continue to do. Its not all your fault, the system is broken, but the good people figure that out and quit. That is why the turn over rate for your job is so high, because it takes a special kind of person to destroy lives.
I am the mother of a little girl. I raised this litte girl for 4 years before she was ripped from my custody based on lies and manipulation. It has been a year, a year of hell and unimaginable grief. Their claims against me were mental health issues and their idea of helping was to rip my family apart. Ive never hurt my child or neglected her. Im no where near a perfect parent, but I am far from an unfit one. Ive struggled with depression and it has been a really hard battle, but despite it all,I still did what I needed to do for my child and I did it with love. I got my butt out of bed every morning to care for my child and although I fell short in some areas, the answer was never this. Ive been alienated and bullied while being forced to watch my daughter suffer over being taken from all shes ever known. Ive watched my bright, beautiful baby girl lose the sparkle in her eye and regress while she begs me to come home.Ive been the focus of her anger and confusion, I am blamed by her, not you. She doesnt understand. Id be lying if I said I didnt lose my mind the day they took her, but of coarse it was twisted on me and used against me. I would like to see the government kidnap your children and you keep your sanity.
There are ways to help and there are ways to hurt people. I cannot believe that you work for a system and dont know the reality of the system you work for or the reality of foster care...or the reality of the chances of these children leading a successful life after losing their families. You know that children are usually safer with their family than in a foster care setting, but you also know there is no money to be made in that. If you only took the children that genuinely needed to be removed and kept the rest of the families together, just getting them the real help they need, you know there would be no money in that, but it would cost money to fund services to really help them. As of right now, you are banking more money than you are losing, so why change a thing? Why? I will tell you why, because family is all we really have in this world. Every family has their issues, I mean, look at our childhoods.None of had a perfect one, but most of us turned out okay regardless and couldnt imagine our life without our crazy relatives. Our children are our next generation in this country, if we continue to hurt them like this, we will continue to see our future generations decline. The money that could have been spent on preserving these families will now be spent on a life time of mental health treatment, welfare benefits, disability, and law enforcement, because those that come out of this system are more times than not destined to this lifestyle. You know this. I know that it runs so much deeper than just that. The time for change is now. Kept together and helped most of us would grow to be half way functional, decent human beings and then the cycle wouldnt be able to continue. The goverment needs this cycle to keep their control over us and keep up their finances.
If you want to help then do us all a favor and stop turning a blind eye to the reality of the system. Do you want to save the children? Quit your job now and stand with us against what is happening to us and our children. If you dont quit your job, then do your job with morals and values. Every family that you meet, think about your own. Realize that you dont know everything and arent an expert at parenting. We are all different and what you think is right isnt always right. Help us, be a friend to us, educate us, support us, lift us up and keep our families together. Comfort the grieving and dont allow the corruption to dictate whether or not you do what is right even if this means standing alone without a job. Our children are too valuable for anything aside from this. There is no amount of money in this world good enough to do what you do. Please, take this to heart, because the change starts with you. God Bless America.
Sincerely,
A broken mother, Crystal Truitt
Warren Sapp accused in domestic violence case
Poor Warren Sapp, it looks like his trouble with women and domestic violence just will not go away. He lost his job on NFL Network for soliciting a prostitute in Las Vegas. We think that sucks, because we feel prostitution should be legalized, taxed, and regulated. While we don't feel it is right for any man to put his hands on a woman, we can understand Warren Sapp's anger. After all, he paid the 2 prostitutes 300 dollars EACH for Sex. Then, they failed to deliver what they had already been paid very well for, and demanded even more money.
His mistake was losing his temper.

Injunction for a paranoid schizophrenic ?

This is a letter from a reader, sharing her experience with an injunction, and asking for advice.
Hello,
My name is ****** and I have been heartbroken by a man I am still madly in love with. He is such a sweet man when he is in his right mind but he is not now. A year ago this past January after spending six months with me hours and hours talking with me and telling me how deeply in love with me he was, he dropped out of my life, told me to stay away, and chased me out of his store for no discernable reason. Several months later my son and I went to his store and he was angry at first but eventually was telling me how deeply in love with me he was. Red flags? He also told my son and I that "entities" were telling him he was a "killer and it is my job to kill people." We had seen a therapist together who had diagnosed him as a paranoid schizophrenic but I didn't want to believe it. After many months of hearing nothing from him and being suicidal over it and him, I wrote several emails to him that bounced back to me.I thought he never received them and tried to kill myself. While I was in the hospital he tried to serve papers against me for harassment. when I got home they were served. The judge at the hearing was a joke. She heard only his testimony and refused me the right to testify or defend myself so I shouted over her in order to get into the court record that he was diagnosed with schizophrenia and heard voices telling him to kill people. She ruled against me anyway.
So I filed an appeal based on the fact that one I did not threaten or harass a "reasonable person" as he was legally insane and was requesting he be evaluated by a court ordered psychiatrist. I am requesting that the injunction be dropped on that basis and because I was denied a chance to make a stand in my own defense. My reply brief to his lawyer must have been significantly damaging or he wouldn't have tried to have it thrown out based on a lie about a nonexistent law(he lied). He never uses lawyers as he is paranoid of using up all his money, but his worst fear is of being involuntarily committed to a psychiatric hospital. My question is, what do I do if he tries to or does contact me? if I call the police won't they take

There was a restraining order put into place on a mother.
The father filed the restraining order. Under that restraining order
was placed the child of the mother, the girlfriend of the father, and
her son.
The father went to prison. Is the restraining order still in place for the
girlfriend? Can the girlfriend legally press charges under the restraining order?
She did press charges and won with no evidence. Her word against the mother.
Never the less, can girlfriend legally press charges, or would it have to be the
father?

Restraining Order Questions From A Reader
...and I have a question about restraining orders.
I am 32 years old, and I was invited to live at my parents house because they knew I had difficulties paying rent while in School. I just about finished my courses. and asked my parents if I could finish a few things this year to graduate, or if they needed me to get a job.
My older sister (48) had been accusing me of not getting a job because I was lazy, but I actually am trying to finish school, and it requires me to be on Campus, for submitting proposals, etc. It has taken a lot longer than I had planned.
Today, both of my parents were stand-offish with me when I was asking a single question and then they accused me of being "violent" when I was about 30 feet away from them and literally asked if there was cleaning agent on the kitchen floor. They did not answer the question directly and I kept asking because I did not want to get a chemical burn from someone cleaning the kitchen. Then they said that I had an attitude problem. They keep saying things to me and I am saying back to them "no, what do you mean, I am just asking about the kitchen" and by the end of it because I still asked them to answer the question they said I need to "get out".
So it is clear they don't want me here, but my main problem is they are accusing me things I did not do or even say. How do I protect myself from their accusations when they are literally making things up in front of me? I feel as though I need a restraining order on them and my sister because they don't listen to me. But I need to move out ASAP too. The problem is that I am not working, I am a FT college student and have no work schedule time available.
Thank you,
Marcus Dupree

According to CDC statistics, intimate partner violence affects 20 Americans every minute, and close to half of women and a fifth of men experience sexual violence at some point, both of which have impacts beyond the immediate physical effects(1). A wide range of factors are believed to trigger domestic violence, and substance misuse has been suggested as a possible cause. However, the link between domestic violence and substance is more complex. While the majority of people who misuse substances aren’t violent towards their partners, a significant number of people who commit abuse also misuse alcohol and drugs. It also appears to be the case people who abuse substances are more likely to become a victim of spousal violence and that this traumatic experience encourages others to turn to alcohol and drugs. A range of theories may explain these associations between substance misuse and abusive relationships, but what is clear is that both victims and perpetrators of domestic abuse who have a problem with alcohol or drugs need specialist support to address their destructive habits and the issues at home.
While the exact link between the abuse of alcohol and drugs and spousal violence is unclear, data collected on the subject shows a significant association between the two. Just a selection of the statistics reported by the Government are shown below:
- Between 25 and 50% of men who commit domestic violence also have problems with substance misuse(2)
- More than 30% of men drank at the time they committed a domestic assault and 90% abused substances on the same day, with alcohol and cocaine abuse most common(3)
- In cases where men try to kill their partner, alcohol is involved in more than two-thirds of cases, and a quarter of those who committed murder had taken both alcohol and drugs(3)
- Perpetrators of domestic abuse are more likely to be imprisoned and their partner to request a protection order if they also abuse substances(3)
- 42% of victims used alcohol or drugs the day they were assaulted, and among those fatally attacked a toxicology screen found that around one-third had alcohol in their system and around one-quarter had used drugs(4)
- Victims of spousal abuse who attend hospital with their injuries are more likely to test positive for intoxication than other admissions(4)
- Around 75% of victims in an abusive relationship who misuse alcohol or drugs are with a partner who also abuses substances(4)
- Women who abuse cocaine and heroin are more likely to experience abuse in a current relationship, though abuse of marijuana and other illicit drugs is associated with violence in a new relationship(5)
There are various possibilities for why a drink or drug habit is linked to violent behavior in relationships, but it is rarely the case that substance abuse is the only factor that precipitates violence, which is why seeking help with alcohol and drug misuse does not necessarily mark the end of domestic abuse, with many partners remaining abusive when abstinent. Firstly, some drugs trigger aggression, most notably cocaine, amphetamines and benzodiazepines, though withdrawal from heroin and marijuana is also linked to violence(5). Equally, drinking can causes changes in someone’s thoughts and emotions, which can trigger violent outbursts. Alternatively, if people believe drugs are more likely to make them aggressive , they may take these substances before a planned attack. Some perpetrators may also misuse substances so that they can blame their habit for their actions, though when it comes to drugs, alcohol and domestic abuse it is sometimes the case that they are used to make their actions seem less of a problem and numb their guilt. In some instances abusive partners may even blame their spouse for their habit, continuing to abuse drink and drugs to exert another level of control.
There is additionally a school of thought that suggests involvement in one destructive behavior increases the likelihood of involvement in another, with similar risk factors associated with committing substance abuse and spousal abuse(5). For example, those who engage in both behaviors are more likely to be a young male, suffer from stress, anxiety, depression or other mental health issues, have a history of behavioral problems and family difficulties, have a low socioeconomic status and feel detached from the community.
Just as there are diverse reasons why someone who abuses alcohol and drugs may commit acts of domestic abuse, there are several possibilities for why someone already abusing substances may become a victim of their partner’s violence(2). While it is never the victim’s fault, when drunk or high this can make them more vulnerable, as it can cloud judgment, make them less aware of what is happening and put them in a situation where it is easier for their partner to take advantage of their state, as they are more likely to be passive to any violence. It is also the case that in environments where substance misuse is tolerated, this is also true of violence. Unfortunately, society is quick to blame victims of domestic violence who have a problem with substance dependency, feeling that they have brought the situation on themselves and that they are not deserving of the same help as others suffering from spousal violence. This negative view is reflected in the action taken by police called out to incidents where assault victims are intoxicated, with officers more likely to blame the victim for the attack(6).
It is common for victims of domestic assaults to become dependent on prescribed tranquilizers, sedatives and painkillers. While these are usually prescribed for legitimate reasons, it is easy for those suffering at the hands of abusive partners to use these drugs to help numb the physical and emotional pain, cope with stress and manage fears of further attacks(5). This is particularly common in cases where victims of violence in the home develop post-traumatic stress disorder or they feel they have no one to talk to about their situation. In some cases a partner may force the victim to abuse drink or drugs, either as a punishment or as a promise that by joining them in their habit they won’t inflict further violence.
When it comes to drugs, alcohol and domestic violence, there are certain signs that can help a partner recognize that the actions they are suffering are down to substance misuse. These warning signs include(7):
- Your partner getting high or drunk more often than usual, particularly during the morning or other times of day when they wouldn’t normally do so
- Your partner using new types of drink or drugs
- Your partner drinking or taking drugs on their own
- Your partner getting anxious or agitated if they don’t have access to alcohol or drugs
- Your partner using drink or drugs to cope with problems
- Your partner taking risks when under their influence such as driving or going to work high
- Your partner experiencing problems with other family members, at work or with the law
If you are already in an abusive relationship, raising your concerns with your partner could easily worsen the situation for you. It is important that you stay safe and avoid putting yourself in a dangerous situation, so talking your concerns through with others is essential. While family and friends can offer you support, seeking advice from specialist drug and alcohol recovery centers about the best approach to take is recommended. This is also the case if you are concerned the abuse you have suffered has triggered your own problems with substance dependency.
Although perpetrators and victims of spousal violence are common in substance abuse programs, the issue of domestic violence is not always addressed and there is often a poor connection between providers of services for those recovering from substance dependency and domestic abuse. It is essential that violent behavior and victimization are explored during the recovery process, as failing to address these can make it more difficult for users to achieve abstinence. Equally, when substance abuse is not dealt with during domestic violence programs, this interferes with their effectiveness. There is indeed evidence that programs for victims that address both domestic abuse and substance misuse are valuable, as demonstrated by a project in Illinois which offered women input from both agencies. Within six months of starting the collaborative intervention women were abusing drugs less often and they also felt more in control of their situation at home(8).
The most common reasons why domestic violence programs do not offer help with substance abuse relate to the fact that their aim is to largely offer shelter and safety, their staff are inexperienced in this area, they have limited resources to pay for specialist services and there is concern that concentrating on substance abuse could increase the likelihood of victim blaming(9). However, research shows that the majority of programs for domestic abuse that do not offer their own treatment for substance misuse refer on to relevant programs in the community and would like to work with specialist alcohol and drug recovery centers to offer an enhanced service. As a result, there is a call for additional funding to bring substance abuse services into domestic violence shelters and to provide integrated treatment programs.
To ensure the issues of alcohol, drugs and violence in the home are properly addressed during substance misuse interventions, not only is it vital for treatment providers to collaborate with local domestic abuse services, but according to recommendations, all staff should receive training on spousal abuse and its health and social implications(10). Substance recovery programs also need to screen those entering treatment for evidence of domestic violence and coercive control, owing to the psychological and behavioral impact of this. Substance abuse treatment services should additionally focus on the wider issues, including domestic problems, that can affect those in recovery, which a holistic and individualized program of care can offer. Recognizing that a partner may sabotage recovery efforts and how this can be addressed is also an important consideration.
It is just as important to incorporate strategies to deal with the behavior of domestic violence perpetrators entering treatment for substance misuse disorders, though a study from 2012 highlighted that just 20% of facilities incorporated this into their treatment and around one-third suspended clients from their program if there was evidence of violence(11). The reasons given for not providing interventions to address violent behavior were also similar to those cited by domestic violence programs in that this was not the aim of their service, their staff lacked training and there were financial constraints. Research demonstrates though that there are particular considerations that should be taken into account when providing treatment for users responsible for violence in the home(12). For instance, a crisis situation must be treated differently, so the plan of action needs to focus on safeguarding the partner and others at home, liaising with both the family and violence support professionals regarding this. There is also the issue that perpetrators of domestic abuse typically blame others for their actions, which can stand in the way of progress in addressing either problem, so fostering accountability is vital and monitoring the degree to which someone takes responsibility can serve as a marker of progress during treatment. Additionally, it is important to assess whether it is intoxication or abstinence that triggers violent episodes, and to draw up a plan offering coping mechanisms to help the batterer to modify their behavior in these situations. Ideally, substance abusers committing violent attacks should be referred to a specialist intervention program for batterers, as this can also enhance their success at giving up alcohol and drugs.
Protective order in Fulton County Superior court Georgia
This is an email from a reader, does anyone have a similar experience, or advice they want to share with her ?
My sister is my nightmare. I came from Los Angeles California to Atlanta, Georgia to care for my mother because she broke her hip also she has dementia. In the 3 months that I've been here, my sister has. Had me in 3 courts eviction, probate and family protection order. My sister had our mother sign a quitclaim to the house. Then she had me served with an eviction which would've taken 30 days. She couldn't wait 30 days so the next step was she had the sheriff serve me with a protection order. It says I threatened to kidnap her baby. Im living in a hotel and i don't know where my mother is. I filed an objection to her petitiotn for our mother's guardianship in probate court. The ridiculous protective order will definitely be dropped because i hired a lawyer but I would love to have my sister be punished by the court for lying and for all the suffering she put me through.

Online National Domestic Violence Database
I’m writing you to see if you have interest in covering in your blog the launch of the country’s very first searchable online database of domestic violence agencies. It’s called domesticshelters.org and includes roughly all 3000 of the agencies in the US.
When someone visits, in a matter of seconds – from a desktop, smartphone or tablet – that person can find help closest to them based on their location, language and service preferences.
This release (https://www.domesticshelters.org/news/site-launches-to-help-millions-of-abuse-victims-find-help-faster-easier-than-before) talks about the important strategic issues this new free non-profit service resolves. Succinctly put, finding help online has been too difficult up until now. The service is offered as a partnership between National Coalition Against Domestic Violence and my family’s charity Theresa’s Fund.
With the recent news about the NFL getting tough on abusive players and October being Domestic Violence Awareness month, and with 25% of women having experienced domestic violence, making your readers aware of this breakthrough service is both timely and potentially life-saving.

Bogus Restraining Orders

Hi Kris, it's been a long time. I thought I'd update you regarding my situation. You may publish this if you like.

Hi Kris, it's been a long time. I thought I'd update you regarding my situation. You may publish this if you like.
My friend and I were victimized by the same individual who had us served with bogus temporary restraining orders in 2010. We are both middle aged females. Our petitioner is a 6'4 professional athlete. He threatened another one of his ex-girlfriends, (because we "packed up on him"). A few weeks later, she died in a mysterious accident.
Several years and many court battles later, I decided to take a different career path. I am now 42 years old, and in my 1st year of law school. I love every class, every word uttered, and every opportunity this experience can afford me. One of my motivating factors was what my friend and I had to deal with, on our own, because a non-American citizen abused our legal system in order to satisfy his own agenda.
My motivation for law school is quite different from that of my fellow classmates. I doubt they've been in a situation in which they felt helpless in a domestic violence hearing, and were unable to afford representation. Though I'm specializing in Entertainment Law, I plan to do quite a bit of pro bono work in the field of bad faith litigation, including helping those victimized through the courts.
What Mr. Knight is doing with this blog is important work. I've already pointed several of my classmates to this blog. If there are repercussions for deceiving the court, if a few cases of abuse of process prevail, perhaps this abuse will at least diminish. Many women worked very hard for many years in order to get legislation passed so that these temporary and permanent orders could be issued. For anyone to abuse that right is perverted. That kind of abuse cheapens the real victim who desperately needs the protection of the court.
I encourage everyone who has been a victim of a bogus restraining order to support individuals such as Mr. Knight, and keep writing your local and state representatives. There are people who can empathize with you and help you. Don't give up, and don't cross any lines so that you prove your accuser to be right. Keep up the good fight, and I hope to return in 3 years with a license to help you.
Thanks,
Misuse Of A Restraining Order
Here is an Email about the misuse of a restraining order that I just received.
hello
i have a case where the person seeking a restraining order against me is i believe doing as a ploy to stop me from asking her if she is going to pay me the balance on a judgement awarded to me. she has never responded to me as of this date. so now i cannot communicate with her in any fashion. very convenient huh?
she brought the very same lies in this restraining order as she brought into the small claims court, as i did this and i did that. after reading all of her lies it took the judge about 2 minutes to favor me.
and even after the judgement was awarded she continued to dupe me, by being very nice to me and crying saying she cannot pay $2305.00 and i ask her what could she pay and she said $100.00 a month and i said ok about 10 days later she pays me $200.00 and then 2 or 3 months pass and i ask her why she stopped paying me, she said i should go to court with her to sign some papers and i agreed to go to court with her. and this is how she duped me, she had a big piles of papers and told me to sign 2 papers saying that the papers was to ensure that she could pay me $100.00 a month and so i signed them not knowing the papers i signed was indeed a satisfaction of judgment. i just lost another $2105.00 from her.
i guess there are dupes all the time huh?
PS - i forgot to say that this lady evicted me because she only recently found out she could make a lot more money obtaining green cards for vietnamese men. so why keep me as a tenant for $500.00 a month when she can make $30,000.00 for every man she gets a green card for.
that was why i sued her. unlawful detainer, she gave me a 30 notice to move but when i was admitted into the hospital she gave me about 30 minutes.
thank you
