I
have a story of restraining order abuse to share with your forum. I’ve
published a detailed account of it online as part of a serial blog
examining restraining order abuses. I’ve also started an e-petition to
attract lawmakers’ attention to them. The web addresses are below. The
restraining order taken out against me has long since expired (March
2007), but I understand from your mission statement that you prefer your
contributors to speak of their experiences in general and not specific
terms. With your permission, this is what I would like to post to your
Restraining Order Abuse blog (and I’m glad to make any adjustments your
forum rules mandate):
I
was stalked several years ago by a woman who lingered nightly for hours
in the dark outside of my house, engaged me in a sexually coercive
relationship for a period of months while concealing from me she was
someone’s wife, then lied to police and swore out a fraudulent
restraining order against me in her husband’s name to conceal her
hanky-panky from him—this while my mother, who had also befriended her,
was being treated for breast cancer.
This woman, a professional scientist and cancer specialist whose father-in-law is the northwest regional medical director for Arkansas
Blue Cross and Blue Shield, both fabricated and falsified evidence, and
will be vulnerable to prosecution for perjury until the fall of 2013.
Her calculated lies to the police and courts included contrived
allegations of sexual harassment and fear of assault to her, to her
husband, to her friends, and even to her mother (who resided in a
different part of the country). Anyone she was concerned I would talk to
about her hanky-panky was alleged to be at risk of violence. The
fallout from her obscene conduct and frauds has taken an immeasurable
toll on me and damaged several others’ lives besides.
I’ve
explored and editorialized on the politics and policies that made it
possible for the woman in my narrative to do what she did in a serial
blog, which I hope will serve as a resource to others, and have posted
an online petition in the hope of brining lawmakers’ attention to these
sorts of abuses of civil process so they can’t continue:

Seems we are not alone at all, due the current events and a restraining order granted to my ex I have currently been stripped of any and all parental rights to our 7 year old daughter based on hear-say from a 3rd party (my ex) who said I force fed my daughter beer at the beach in January, 2011. Due to the Restraining Order in place I was only allowed to see my daughter every other weekend (Before I had her half the week). My ex was not showing up for the child exchange or accepting my calls for me to speak to my daughter so I kept all my time stamp cards from the HSCO office as proof for court. I went and filed a motion for contempt of court for not following the judges court ordered visitations and 10 minutes after she was served by a process server I had a DCF abuse call placed on me. (Stating I forced my daughter to drink beer back in Jan, 2011 - Yet just reporting it now.. at that time July.) -- Needless to say, Department of Children and Families has their hands full now! I signed the petition, and passed it along. We have to keep this issue in front of the politicians, and the legislators.
ReplyDeleteWow, that's quite a concern! I just hope this kind of case will be resolved and I fully support those who are receiving restraining orders which are not due to them.
ReplyDeleteI never thought that this is already happening nowadays and never heard about this case before. But its really a big concern, all the false accusations are being taken legally and it will surely affect other's lives and the fact that they don't even know the restraining order being held to them. Hope other people will also be aware of this kind of fraudulent conduct.

I have 2 daughters with my ex wife who were born after our divorce. I found out this April that she had been defrauding public assistance since 2007 by claiming I was an absent dad and she had no income. She stole in excess of $40,000. when she was informed of the investigation she asked me to leave the home I alone had worked to pay for and my daughters so that if an investigator came to the house she could show I didn't live there. I refused as she had no job and had only stayed there because she is basically an unfit mother.When it became apparent I would not leave she took our daughters and my sister finally contacted her after 2 weeks of me going insane and calling every agency in the book to locate them. She was in a women's shelter falsely claiming I had denied our youngest daughter medical treatment and broken a phone I owned but let her use. I was served a PO on the July 4th weekend on a Friday when I had no access to the courts for 3 days. I had just came off 3 months of 4 day weeks and a month long layoff and could not afford an atty. At the hearing she had no evidence whatsoever to support any of her allegations yet the Judge, Judge Barbara Crawford Ct. 21 in Indianapolis IN rubberstamped the PO and let it stand. I lost my possessions which I now have to retrieve through small claims ct. my home, and for 3 months till I was granted parenting time my children. This unconstitutional process must be changed too many innocent lives a are being ruined by unscrupulous people who know the system is a no brainer to bypass the law.
ReplyDeleteWell well, what I suspected all along, has been confirmed. The moron, who filed a tro against me and another ex girlfriend, conspired with his attorney to lie, and spin information, in order to get the tro's signed. I had a source come forward, who overheard numerous conversations between the 2 of them. The attorney DID, thank GOD, lose her job over the ordeal. I also found out, these tro's were conceived, when 3 of us ex girlfriends, showed up together at a horse show, and he wanted to intimidate us into not showing up at another PUBLIC EVENT, in the future. I wish the attorney could be disbarred and thrown in jail for her part in it.
ReplyDeleteCan someone clear something up for me? When you are served with a tro, if the petitioner has an attorney, do they get a return copy? Don't they know what day it's served? I'd appreciate any input.
ReplyDeleteAs I right this message I am in pain. My domestic partner and mother to my 18month old son has filled a restraining order against me. I am in a motel with only the shirt on my back I have lost my house , shop, tools, and all personal effects, as well as I cant see my son etc...This happened about a week ago. I have not even been allowed on the property to get a toothbrush. My world is in shambles. The false accusations she has made in the report make me ill to read. She disappeared with my child for about a week before the police pulled me over in my driveway and served me papers, like I said I'm glad I had my wallet in my pocket because I was not allowed in my house or near my property and I cant try and communicate with my domestic partner at all. She has said nothing to me. I have never hit or hurt her in any way, yeah we argue but WTF...It has now been 8 days since I last saw my son and I fear my family is now ruined. She claimed that I said I had thoughts of killing my family!!! as well as allot of other crazy stuff. Truthfully after she has gone and done this I still want resolve....That is the test right there.
